Stabroek News: A day after denying allegations of sexual molestation, Speaker of the National Assembly Raphael Trotman yesterday secured an injunction barring his accuser from publishing any material relating to the allegations in the print or electronic media.
Trotman has also sought damages in excess of $50 million for libel contained in a statements allegedly made by Welshman and published in the Stabroek News, Guyana Times and on Welshman’s Facebook page.
The AFC statement also expressed the party’s unequivocal support for Trotman, its co-founder in face of the recent “spurious and unfounded allegations leveled against him.”

    The Alliance For Change (AFC) on Friday accused Attorney General Anil Nandlall of helping to hatch a plot of alleged sexual abuse of a minor against House Speaker Raphael Trotman, but Nandlall has rebuffed those charges.

    “The AFC has received information that apart from the involvement of the staff, the Senior Government official was himself directly involved in the falsification of the allegations leveled against Mr Trotman and the overall scheme to tarnish his reputation,” said the AFC’s General Secretary, David Patterson.

    Reacting sharply to the AFC’s claim, the Attorney General expressed “utter shock” at being added to the long list of persons that has been implicated in the accusation against the Speaker. Nandlall bluntly denied any involvement. “The AFC has received information that apart from the involvement of the staff, the Senior Government official was himself directly involved in the falsification of the allegations levelled against Mr Trotman and the overall scheme to tarnish his reputation,” he said in a statement.

    Attorney-at-Law Jaya Manickchand , who is the sister of Education Minister Priya Manickchand, has also denied being part of a scheme against Trotman. While she has denied meeting Welshman on this occasion, she has acknowledged exploring the possibility of the Speaker privately compensating Welshman and offering an apology.

    Trotman, who is the AFC’s co-founder, earlier Friday participated in a news conference at which the allegation was leveled against the Attorney General. The House Speaker has reiterated his innocence of the sexual assault allegation by 22-year old Johnny Anthony Welshman who said the acts were committed on him when he was 13 years.

    The Attorney General admitted speaking with the House Speaker by telephone on Tuesday September 23 long after the allegations of sexual misconduct were made public. He said that as a result of that conversation, he made certain inquiries of the professional staff at the Attorney -General’s Chambers.

    Nandlall said that those enquiries revealed that Welshman- “whom to date I have never seen or spoken with”- met State Counsel , Ms. Leslyn Noble at the said Chambers. The Attorney General said that he learnt that Welshman and Noble had known each other long before and were acquainted somewhat.

    Nandlall said he was never present at or authorized that meeting and that he was unaware of the reason for the engagement and the content of the discussion. “I did not solicit any information regarding the nature of the discussion which took place thereof because I formed the opinion that it was of a personal nature,” said the Attorney General.

    Nandlall did not address the AFC’s specific allegation that the officer had directed Welshman to meet with Attorney-at-Law Manickchand.

    He described as “unfortunate that in their quest to extricate their own, from this morass , the AFC is prepared to implicate so many others.”

    The AFC General Secretary accused the Attorney General of directing Welshman of seeking legal representation.

    According to that party, Welshman’s allegations are nothing more than a scheme to avert the impending no confidence motion.

    The AFC theorized that the allegations were aimed at removing Trotman from the Speakership in a bid to delay debate and eventual passage of the motion.

    A Partnership for National Unity (APNU) intends to add its 26 seats to the AFC to pass the motion in the House where the government has a one-seat minority.

    When approved, President Donald Ramotar and his Cabinet would have to resign and call general elections within 90 days or a time-frame agreed to by the 65-seat House.

    Attorney General and Minister of Legal Affairs, Anil Nandlall has sought to clear himself in the sex scandal involving Speaker of the National Assembly and Alliance for Change (AFC) Founder Member, Raphael Trotman.

    The AFC today alleged that Nandlall was directly involved in the “fabrication of the allegations” against the House Speaker and that he directed Trotman’s accuser – Johnny Welshman – to seek the representation of Attorney, Jaya Manickchand, who is also closely aligned to the ruling People’s Progressive Party.

    In a statement issued this evening, shortly after iNews published the story, the AG said, “It is with utter shock that I learnt that I am the latest casualty in a long list of persons implicated by the Alliance For Change ( AFC ).”

    “I wish to absolutely and categorically deny any involvement in, or connection with, either directly or indirectly, the said sexual assault fiasco.”

    However, he admitted that Welshman did visit the Chambers but did not meet with him; instead he met with State Counsel, Leslyn Noble in a personal capacity.

    “On Tuesday 23rd September, 2014, i.e. long after the allegations of sexual misconduct against Mr. Trotman were made public, I spoke with Mr. Trotman via telephone. As a result of that conversation, I made certain inquiries of the professional staff at the Attorney – General’s Chambers. Those inquiries revealed the following:

    Approximately one week before, Mr. Johnny Welshman , a person, whom to date I have never seen or spoken with, met State Counsel , Ms. Leslyn Noble at the said Chambers ;
    I learnt that these two persons had known each other long before and enjoyed some degree of acquaintance;
    I obviously was not present at, or authorised the holding of that meeting, and indeed only became aware that these persons knew each other and met at the AG Chambers when I made those aforesaid inquiries;
    To date I am unaware of the reason for that engagement and the content of any discussion which may have taken place thereof;
    I did not solicit any information regarding the nature of the discussion which took place thereof because I formed the opinion that it was of a personal nature.”
    Trotman has since denied the allegations, in which Welshman claimed that he raped him some ten years ago.

    “Mr Trotman, following the receipt of the information, contacted the Head of the Ministry and a Member of Parliament via telephone and asked for an explanation. The Senior Government functionary, at the time, denied any involvement. A short time afterwards, the government functionary returned a call to Mr Trotman confirming that an official in his office did meet with Mr Welshman and who further directed him to Jaya Manickchand,” Patterson explained.
    He further noted that the AFC received information that Nandlall was directly involved in the falsification of the allegation leveled against Trotman and the overall scheme to tarnish his reputation.
    “I never molested any child”
    Meanwhile, Trotman, in brief remarks, again denied the allegations.
    “I have never in my life committed in any acts of a sexual nature that is illegal. I have never molested a child – male or female – and I have never, as a matter of fact, even as Counsel represented any person charged with similar offences.
    “At no time did I ever and I will never in my life do anything to hurt any child or commit any offence of a sexual nature. That’s all I want to say.”
    Trotman maintains that he will not resign as Speaker of the National Assembly.
    “Welshman has psychological difficulties”

    AFC Executive Member, Moses Nagamootoo said the Party is concerned about the young man’s state of mind, as he is “clearly in a state of considerable psychological stress.”
    Nagamootoo is of the view that the young man is not afforded “proper treatment.”
    “Judging by his public statements and most recently his Facebook posting, particularly in relation to Jesus being his legal advisor and having nowhere to sleep, clearly demonstrate that Mr Welshman is in a state of considerable psychological difficulties.”

    Meanwhile, the AFC also lashed out at Manickchand, stating that she was also part of the scheme to “entrap Trotman into paying hush money to suppress his alleged involvement in a most heinous crime thereby securing from him an admission in his participation of the alleged crime and confirming that he had something to hide in the payment of the hush money.”

    Manickchand has since admitted to contacting Trotman on behalf of Welshman; however she maintained that he [Welshman] did not retain her services.
    Several text messages released by the AFC, shows Manickchand attempting to convince Trotman to reach “a quick” settlement with the young man.

    According to the AFC, Trotman in response to Manickchand recommended that Welshman make a report to the police.
    According to the AFC, their information also suggests that the young man was promised a job upon his return to Guyana from Trinidad and Tobago and that he has reopened his bank accounts since his return.

    Vice Chairman of the Alliance For Change (AFC), Moses Nagamootoo stated at the party’s weekly press conference yesterday, that he is deeply concerned over the admission by Attorney-at-Law Jaya Manickchand that she had initiated an enterprise which could have resulted in the perversion of the course of justice.

    Johnny Terry Welshman Jnr., the young man who recently accused House Speaker, Raphael Trotman, of sexually molesting him when he was younger, had said that he had retained the services of the lawyer. But Manickchand has vehemently refuted the allegations.

    The AFC however, uncovered and disseminated text messages from Manickchand’s cell phone number which indicates that she apparently tried to settle the matter discreetly with Trotman, despite stressing mere days before, that she was not looking out for Welshman’s interest.
    The political party has concluded that “the troubled young man” may be part of a scheme to entrap the House Speaker and tarnish the AFC.

    The Attorney-at-Law subsequently posted on her Facebook page, a detailed statement in defence of her actions.
    Nonetheless, Nagamootoo told media operatives yesterday that Manickchand, in her letter to the press admitted to contacting Trotman. The Vice Chairman said that the result of her actions, were Mr. Trotman to have fallen for Manickchand’s entreaties, would have enmeshed the House Speaker in criminal activity.
    He said that the clear intention of Manickchand’s scheme was to “entrap Mr. Trotman into paying hush money to suppress his alleged involvement in a most heinous crime, thereby, securing from him an admission of his participation in the horrible crime and confirming that he had something to hide by the payment of the “hush money”.
    Nagamootoo asserted that Trotman immediately refused to participate in any such scheme and recommended that

    Manickchand’s client make a report of the alleged crime to the Guyana Police Force.
    He said too that the AFC is appalled that a former Commissioner of the Guyana Elections Commission nominated by the People’s Progressive Party Civic would consider initiating such a scheme, “the sole purpose of which was to pervert the course of justice and suppress an allegation of huge proportions.”

    Nagamootoo expressed that Manickchand was acting in her professional capacity and was soliciting funds for an alleged victim of a serious crime from the alleged perpetrator in return for making the criminal matter disappear. He believes that “the admission of participation in such a venture should not escape the attention of the relevant authorities.”

    The AFC Parliamentarian stated that his party is not at all persuaded by the public protestations of the former PPPC Elections Commissioner that she was “giving a friend a head’s up.”
    “If this was indeed the intention, what should have transpired was that Manickchand would have advised the alleged victim to report the matter to the police, inform him that she was unable to act on his behalf and thereafter, notify her colleague of the serious allegations which were being leveled against him and inform him that a report to the Police was advised.”

    The Alliance For Change is concerned that a young person who clearly seems to be in a state of considerable psychological distress has not been afforded the proper psychiatric and professional assistance that he clearly is in need of.” He reiterated that the AFC stands behind its founding member, Raphael Trotman, and former party leader and calls for a “full, frank, thorough and open investigation of the allegations made against the Speaker.”

    The political opposition believes that a recent article in “that thing called the Chronicle newspaper” which said that
    an opposition member called for the resignation of House Speaker, Raphael Trotman pending the outcome of the sexual abuse allegations against him, is nothing but a plot designed to cause a parliamentary crisis.

    They believe that it was clearly designed to be a “red herring”—information intended to mislead or distract from a most crucial matter, to wit the parliamentary debate on the no-confidence motion.

    However, the House Speaker has made it clear that he has known of similar cases where persons were accused but only resigned when they were charged. He highlighted a case back in 2013 where the Deputy Speaker of the British House of Commons Parliament was accused of sexual misdemeanors. He did not resign when faced with the allegations but when he was charged he stepped down from the Constitutional Office.

    Trotman said that Guyana is a signatory to the Commonwealth Parliamentary Association from where he has received advice. And based on the advice he has received, he would not be stepping down based on “baseless and malicious” accusations that are being leveled against him.
    Trotman, when asked whether he would resign if charges were leveled against him, said that he would speak on that matter on Tuesday at a press conference.
    “I am a patriot. I love my country. I love the fact that I can serve Guyana as Speaker but I will do nothing to injure the reputation of the National Assembly and/or to interfere or impede the business of the House including a no confidence motion.”
    He said that he would not do anything that would divert from the smooth running of the business of the House. He added, “Rest assured that I will do what is right and in the interest of Guyana.”
    The Attorney at Law said, “I have never in my life committed any act of a sexual nature that is illegal. I have never molested any child, male or female, and I have never, as a matter of fact, even as Counsel, represented a person charged with a similar offence because of my abhorrence of matters of this nature.”
    AFC General Secretary, David Patterson, said that the intention behind “this outrageous attack” against Trotman is to derail the no confidence motion.

    Vice Chairman of the AFC, Moses Nagamootoo, said that this is clearly being done to create “a parliamentary crisis.”
    “If you don’t have a Speaker then you have uncertainty to have a motion discussed. Trotman has made a ruling on the admissibility of the motion and it would come on the order paper when Parliament resumes and I can assure that I will be there to move that motion unless something untoward happens,” Nagamootoo expressed.
    The AFC made it clear that based on its inquires, no opposition member has called for the resignation of the House Speaker in any regard and as such urged the Chronicle Newspaper “to up their stories.”

    Johnny Welshman Jnr, the young man at the centre of an alleged sex scandal against Speaker of the National Assembly, Raphael Trotman, and his father Johnny Welshman Snr, has now implicated a Yarrowkabra businessman, claiming that the man abused him 10 years ago.

    But investigators who took the accuser to the Soesdyke/Linden Highway area found that the scene of the alleged rape did not even exist 10 years ago. Like Trotman, the businessman knows Welshman’s father. Kaieteur News understands that it was shortly after noon on September 29, last, that Welshman, who was in the company of several police ranks, visited the business place at Yarrowkabra, a small community along the trails, just off the highway.

    The businessman said that he saw the people walking through his gate and thought they were customers. “I really didn’t take it seriously…but is when they said they had an allegation against me, everything changed.”
    Kaieteur News was told that the businessman was told of the allegation, which said that he sexually molested the young man some ten years ago on his property.

    The man said that he was shocked and very disturbed about the allegation, and denied it outright in the presence of the police and Welshman.
    “I was very vocal about it…Immediately after they told me I said no…This can’t be the same person or house,” the businessman said.
    He said that at this point the police requested to search his property, something he initially refused to do. However, after speaking with his wife and another friend he allowed them to enter the house.
    According to the businessman, the police instructed the accuser to point to spot where the alleged sex act happened. According to the businessman who asked that his name be kept out of the saga, “Soon as he walked in the house he look dazed….It’s like if he now seeing the place for the first time and feeling his way around.”
    The man said that Welshman pointed to a section of the building in which he said he was sexually molested.
    The funny thing about that section of the property is that it was only constructed three years ago. “He point to this wall…now everybody in the community knows that I only did this extension to the property recently.”

    The businessman, to support his claims, even has dated photographs when the business place was a mere shack. While in the company of the businessman and police, the accuser continuously asked about another one of his father’s friend who lived a short distance away.
    “He keep asking for the man, but is a good thing the man living abroad because he would have been dragged into this nonsense, too,” the businessman said.

    After pointing to the spot where the “alleged incident” happened, the businessman said that investigators invited him to the Criminal Investigation Department. The man said that this again took him by surprise, but he nevertheless complied.
    Upon arriving at the station the man said that the police asked him to give a statement. He said that he started to become agitated. “I told them that I wasn’t giving any statement since I already told them I didn’t know this Welshman character.”

    He further told Kaieteur News that the police subsequently drafted up a document which stated that he had refused to give a statement. The business said that he signed that.
    Thinking that it was the end of his ordeal, the businessman said he was taken into a dark, rat infested cell. The man said he spent approximately eight hours in the cell, until about 22:00hrs that night before the Crime Chief, Leslie James, said that he could be released.
    To date the businessman said that he has not heard back from the police.

    Earlier last month Welshman came forward with allegations that Trotman had sexually assaulted him as a child. These allegations have been denied flatly by Trotman, who call the actions of Welshman “malicious”.
    The High Court has also granted an injunction barring Welshman from publishing, whether in the print or electronic media, any material relating to allegations he made against Trotman.
    That matter is still pending in the courts.

    Welshman had also claimed to have met with the Venezuelan Ambassador, something the embassy here in Georgetown has denied, too.
