Drug traffickers appear to be gaining a significant foothold in Guyana’s timber industry. Businessman claiming US$97,733 from Aurelius Inc. - Guyana Chronicle - In the Courts - Sept 6 2005
THE Aurelius Inc. and Shaheed Khan, Defendants, who, it is alleged, have failed to honour a US$1M promissory note in favour of businessman Harry Rambarran, are to appear in Court on October 3, 2005, in keeping with a claim for an unpaid sum of US$97,773, filed against them.
The writ was filed in the Supreme Court Registry last Friday.
The first defendant is a company incorporated in Guyana on the April 6, 2004, under the provisions of the Companies Act, 1991.
On July 13, 2005, the second defendant for the first defendant, executed a promissory note in favour of the plaintiff for the sum of US$1,100,000, expressed to be payable in 12 equal monthly instalments of US$97,733, commencing February 15, 2005, and on the 15th day of each succeeding month with interest at the rate of 12 % per annum, payable without demand.
It was a condition of the promissory note that failure of the first defendant to pay to the plaintiff or his agent the sum of US$97,733 on the dates they become due and payable, the whole amount remaining unpaid shall become due and payable.
According to the statement of claim, the first defendant has failed to make the payments set out in the said promissory note to the plaintiff as they became due on the 15th February, 15th March; 15th April; 15th May and 15th June, 2005.
On the March 16 , 2005, the first defendant paid the sum of $19,691,000 or US$96,524; on the 13th April, 2005 the defendant paid the sum of US$78,568 making a total of US$175,092.
As a result of the company’s failure to make payments on the dates they became due, the entire unpaid balance of $997,712 became due and payable to the Petitioner as at the July 12, 2005.
It was pointed out that the second defendant incorporated or caused to be incorporated the first defendant as a ‘shell’ company, a mere façade with the sole purpose of using it as his agent and putting the first defendant’s assets beyond the reach of his creditors in the probable event of litigation.
As a consequence, the plaintiff claims from the defendants, jointly and severally, the sum of US$997,712 payable in Guyana dollars at the NBIC Cambio selling rate, being the balance of an amount due by the defendants to the plaintiff under the promissory note.
